Upon termination, all outstanding obligations become immediately due and payable. You may terminate your account by contacting us, subject to settlement of all outstanding obligations.

Disclaimers and Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, INCOXCHANGE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• • Warranties regarding accuracy, reliability, or availability
• • Warranties that the Service will be uninterrupted or error-free

IncoXchange does not guarantee approval for any financial service and reserves the right to deny applications based on creditworthiness, risk assessment, or other business criteria.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INCOXCHANGE, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

• • Any damages exceeding the amount paid to IncoXchange in the twelve months preceding the claim

Indemnification

You agree to indemnify, defend, and hold harmless IncoXchange and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service, violation of these terms, or infringement of any rights of another party.

Governing Law and Dispute Resolution

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions.

Any disputes arising from these terms shall be resolved through:
